The agreement between you and eScripts when you use our website, app, trials, subscriptions and related services.

Please read these terms carefully. They are written in plain language as required by the Consumer Protection Act, and they work together with our Privacy Notice, Acceptable Use Policy, Subscription Policy and Tax & AI Disclaimer.

1. Electronic agreement and capacity

These terms form a binding electronic agreement between you and Skarsity (Pty) Ltd (registration number 2020/891049/07), the company that operates and trades the eScripts service. References to “eScripts”, “we”, “us” and “our” in these terms mean the eScripts service and Skarsity (Pty) Ltd as its legal operator. By creating an account, subscribing or using the service you accept them. Electronic agreements, signatures and records are recognised under the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

You must be 18 or older, or have the legal capacity and authority to contract. If you use eScripts for a business, you confirm that you are authorised to bind that business.

2. Your account

You must give accurate registration information and keep it up to date. You are responsible for your login credentials and for activity on your account. Tell us immediately at info@escripts.live if you suspect unauthorised access.

One account is for one person or one business, unless we agree otherwise in writing.

3. What eScripts provides

eScripts is software (SaaS) that helps you organise tax and financial records: expenses and receipts, document capture and scanning, income records, bank statement imports, vehicles and mileage logbooks, tax estimates and readiness indicators, an AI assistant, Tax Packs, business quotations, invoices and VAT tools, and consent-based practitioner collaboration.

You stay in control. Imported bank lines, scanned amounts, tracker trips and suggested categories are proposals until you review and confirm them. eScripts does not automatically treat business spending as tax deductible.

4. 14-day Complete Trial

New users receive a 14-day Complete Trial so you can experience the product areas, subject to sensible fair-use allowances shown in the app. During the trial, generated downloads and exports remain locked until you take a paid plan.

When a trial or subscription ends, your records are not deleted. The workspace becomes read-only so you can still view your history until you choose a paid plan.

5. Subscriptions and billing

Plans (Essential, Pro and Business) are offered on monthly or annual intervals at the prices shown on the website and at checkout. Payments are processed by PayFast. Recurring billing only happens where you have authorised it, and you are told the amount and interval before you confirm.

6. Cancellation

You can cancel future renewals through the account channels available to you or by contacting info@escripts.live. Cancellation stops the next renewal; it does not automatically delete your records. Deletion is a separate request — see our data rights page.

7. Your consumer rights

Nothing in these terms limits rights you have under the Consumer Protection Act 68 of 2008 (CPA), ECTA or other law that cannot be contracted out of.

Section 44 of ECTA gives a consumer a seven-day cooling-off right for certain electronic transactions. However, section 42(2)(d) of ECTA provides that this right does not apply to services that the consumer expressly requested be performed before the cooling-off period expires. When you activate a trial or subscription and start using the workspace immediately, you are asking us to begin performing straight away, so the section 44 cooling-off right may not apply to that service. This does not waive any other CPA or statutory right, including fair cancellation, quality and refund rights.

8. Your records and content

You own your records, documents and data. You grant eScripts only the limited, non-exclusive licence needed to host, store, process, render, back up, export and share that content in order to operate the service on your instruction — for example, to display a receipt, generate a Tax Pack, or share records with a practitioner you have authorised.

You confirm that you have the right to upload the content you submit, including where it contains other people's personal information such as your own clients' details.

9. Acceptable use

You may not use eScripts unlawfully, fraudulently or abusively. Our Acceptable Use Policy forms part of these terms and sets out prohibited conduct and our right to investigate or suspend accounts where reasonably necessary.

10. AI, scanning and tax estimates

The eScripts Assistant, document scanning (OCR), classification suggestions, tax estimates and readiness indicators are assistive tools. They can be incomplete or wrong and must be reviewed by you before you rely on them.

eScripts is not SARS. A tax estimate produced in the app is not a SARS assessment, and we do not guarantee that an expense is deductible, that a trip qualifies as business travel, that a refund will result or that SARS will accept any evidence. See our Tax, AI & Professional Services Disclaimer.

11. Professional tax services

Professional services — practitioner consultations, return preparation, SARS verification or objection assistance, tax clearance, logbook reconstruction, bookkeeping clean-up and assisted filing — are separately priced and are not included in a software subscription. A professional engagement only starts once scope and fees are confirmed and accepted. Where the Tax Administration Act 28 of 2011 and SARS requirements apply, work involving tax advice or completing or assisting with a return for consideration will be performed by a person who is appropriately registered with SARS and a Recognised Controlling Body. Subscribing to the software alone does not create a practitioner-client mandate.

12. Third-party services and imports

eScripts works with third-party services such as PayFast, Google and Apple sign-in, place and location services, email delivery, and files that you export from your bank or tracker provider. We are not responsible for the accuracy, availability or terms of those third parties. Imported files reflect what the provider produced; you remain responsible for checking them.

13. Availability, maintenance and suspension

We work to keep eScripts available and reliable but cannot promise uninterrupted service. Planned maintenance, upgrades, third-party outages and events beyond our control may affect access. We may apply reasonable fair-use and technical limits, and may suspend or restrict an account where necessary for security, suspected abuse or unlawful use, or non-payment. Where practical we give notice first.

14. Our intellectual property

The eScripts platform, software, design, brand, logos and documentation belong to eScripts and its licensors. You get a limited, revocable, non-transferable right to use the service during your trial or subscription. You may not copy, reverse engineer, resell or create derivative works from the platform without our written permission.

15. Warranties and liability

We provide the service with reasonable skill and care. Apart from the rights the CPA, ECTA and other law give you and that cannot be excluded, the service is provided on an "as is" basis and we do not warrant that it will be error-free or meet every requirement.

To the extent the law allows, eScripts is not liable for indirect or consequential loss, loss of profit, penalties or interest arising from your own tax submissions, or loss caused by inaccurate information you supplied. Where we are liable, our total liability for claims arising in any 12-month period is limited to the subscription fees you paid to eScripts in that period.

Nothing in these terms excludes or limits liability for gross negligence, wilful misconduct, fraud, death or personal injury, or any liability that may not be limited by law.

16. Indemnity

To the extent the law allows, you indemnify eScripts against claims, losses and reasonable costs arising from your unlawful use of the service, your breach of these terms, or content you upload that you were not entitled to upload. This indemnity does not apply where the claim results from our own gross negligence or wilful misconduct.

17. Termination and closing your account

You may stop using eScripts and request account closure at any time. We may terminate or suspend access for material breach, unlawful use or extended non-payment, with notice where reasonable. Before closure, export the records you want to keep. After closure we delete or anonymise personal information except where we must keep it for legal, tax, audit or dispute purposes, and backups cycle out over time.

18. Notices, governing law and changes

Notices to you are sent to your account email address; notices to us go to info@escripts.live. WhatsApp and phone support are convenience channels and are not accepted as formal service of legal process.

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. If any clause is found unenforceable, the rest continues to apply. We may update these terms; the revision date at the top of the page shows the current version and continued use after a material change means you accept it.
